AKTA SEWA — SIMPLE FORM
1. Parties. PT CYBER VALLEY ESTATE, PT PMA, domiciled in Gesing, Banjar, Buleleng, Bali, NIB [] (the "Landowner"), and [] (the "Holder").
2. Plot. The parcel marked on the ground (patok) and described in the attached peta bidang, ±[] m², part of HGB certificate No. [].
3. Grant, term and quiet enjoyment. The Landowner leases the Plot to the Holder (hak sewa) for [___] years from signing, within the remaining term of the certificate. The Landowner warrants its right to lease the Plot and does not disturb the Holder's use while this deed stands.
4. Rent. The rent for the whole term (uang sewa), as recited in this akta, is Rp [___] (the "Recited Rent") — the value at signing of the fixed quantities carried in Annex E, converted at JISDOR on the signing date. 30% of the Recited Rent is paid at signing; the balance is due within one year of signing.
What the akta cannot recite. A notary and PPAT register a price in rupiah, not in units of an external index — Annex E's quantities and its formula are the private mechanism the parties use to compute the Recited Rent and every later instalment; they are not themselves stated as the unit of account in this akta. Where the balance falls due later than signing, its rupiah amount is recomputed from Annex E as of the payment date, per UU 7/2011 on denomination and settlement.
5. Late balance. Units unpaid one year after signing convert to equal annual instalments over the following [5] years, each valued on its due date. If an annual instalment is not paid within 30 days of its due date, the Landowner may terminate this deed by written notice; units already paid are not refunded — they pay for the time already enjoyed.
6. Use. Lawful use consistent with the estate's published rules as at signing. No nominee arrangement (perjanjian pinjam nama); nothing in this deed simulates freehold for a foreign party.
7. Form and language. Executed as an akta before a notary / PPAT in Bahasa Indonesia and English; the Indonesian text prevails on discrepancy.
8. Law and disputes. Law of the Republic of Indonesia. Good-faith negotiation for 30 days, then arbitration under BANI rules, seat Bali, in English.
